Terms of Service

1. Acceptance of terms

By accessing the CaribSailing website, requesting a booking, or boarding any of our vessels, you accept these Terms of Service. If you do not accept these terms, please do not use our services.

2. Description of services

CaribSailing offers guided multi-day sailing trips, day charters, private charters, and themed retreats aboard our yacht. Routes, durations, and inclusions are described on individual tour pages. We reserve the right to adjust routes for weather, safety, or guest welfare.

3. Bookings, deposits, and final payment

Bookings are confirmed when a deposit is received. The deposit amount is TK of the total trip price. The remaining balance is due TK days before departure. Late final payments may result in cancellation of the booking with the deposit forfeited.

All prices are quoted in USD unless stated otherwise. Bank fees, currency conversion, and third-party booking platform fees are the responsibility of the guest.

4. Cancellations and refunds

Cancellation terms depend on the notice given before departure:

  • More than TK days before departure: full refund minus the deposit.
  • Between TK days and TK days before departure: TK percent refund.
  • Less than TK days before departure: no refund.

We strongly recommend travel insurance that covers trip cancellation, medical emergencies, and personal liability.

5. Changes or cancellations by us

Safety comes first. If weather, sea conditions, mechanical issues, or events beyond our control make a trip unsafe, we may delay, reroute, shorten, or cancel the trip. In those cases we will offer one of: a rescheduled trip, a partial or full refund proportional to the change, or a credit toward a future trip. Decisions are at the captain's discretion.

6. Guest responsibilities

  • All guests must be at least TK years old, or accompanied by a parent or legal guardian.
  • Guests must be in reasonable health and able to move safely around the vessel. Disclose relevant medical conditions when booking.
  • Follow the captain's safety instructions at all times. The captain's authority on the vessel is final.
  • Illegal drugs are not permitted on board. Excessive intoxication that affects safety is grounds for ending the trip without refund.
  • Treat the crew, other guests, and the vessel with respect. Damage caused by guest negligence may be charged to the guest.

7. Insurance

We carry vessel liability insurance as required by law. Personal travel and medical insurance are the responsibility of each guest. We are not responsible for guests' personal possessions or for medical costs incurred during the trip.

8. Liability and assumption of risk

Sailing carries inherent risks, including but not limited to weather changes, equipment failure, motion sickness, sun exposure, and injury during onboard activities (swimming, snorkeling, paddleboarding). By participating, you acknowledge these risks. To the maximum extent permitted by law, CaribSailing and its crew are not liable for indirect, incidental, or consequential damages arising from participation in our trips.

9. Force majeure

We are not liable for failures to perform caused by events beyond our reasonable control, including but not limited to severe weather, natural disasters, government restrictions, civil unrest, port closures, or pandemics. In such cases we will work with affected guests to reschedule or provide reasonable alternatives.

10. Intellectual property

All website content, photography, logos, and tour itineraries are the property of CaribSailing unless otherwise credited. You may share our content for personal, non-commercial use with attribution. Commercial use requires written permission.

11. Governing law and dispute resolution

These terms are governed by the laws of TK jurisdiction. Any dispute that cannot be resolved through good-faith discussion will be submitted to binding arbitration or to the courts of TK jurisdiction, at the operator's discretion.

12. Changes to these terms and contact

We may update these terms from time to time. The current version is always posted on this page with the date of last update. Continued use of our services after changes constitutes acceptance of the revised terms.
